Even after 64 days of lockout of ACC Cement Factory Barmana, the patience of the truck operators has broken due to no conclusion of the issue.

Everyone has unanimously decided that the boundaries of Bilaspur district will be sealed from Friday, under which no truck carrying cement will be able to enter the state border from outside states.

In this context, BDTS has also informed the Deputy Commissioner in writing. Also requested to open the lockout of the factory as soon as possible. This decision has been taken in the meeting at Barmana on Thursday.

In a written letter submitted by BDTS Pradhan Rakesh Thakur Rocky to the Deputy Commissioner, it has been said that the deadlock between the Adani group and the truck operators is going on for the last 64 days, but there is no result even after several talks with the Adani group mediated by the state government.

The letter also states that ACC Cement Company has been closed by Adani Group with effect from December 14, 2022. Today, 64 days have passed since we have been protesting, but till now no hearing is being held anywhere.

That’s why all the transporter friends have decided that from Friday onwards all the borders of Bilaspur district will be sealed, in which no truck will bring any kind of goods to Bilaspur district.

The Deputy Commissioner has also been urged to open this lockout as soon as possible, so that the crisis facing the truck operators can end.

According to BDTS head Rakesh Thakur Rocky, the meeting with the Adani group mediated by the CM in Shimla did not yield any result. Although the government is on the side of the operators and is trying to resolve the issue through continuous talks, the Adani group is adopting its stubborn attitude.

Not only this, the haulage rate has recently been increased to Rs 10.71 by UltraTech Company. When Ultratech company is increasing the freight rate, then why not ACC and Ambuja. In such a situation, the operators are left with no option but to fight a very decisive battle.

Bhanupalli-Bilaspur Barry broad gauge rail line tunnel number-14 work will start soon

The officials of the producer company DBL reached Bilaspur and informed the administration officials about this.

The DBL company, which is working on the construction of two bridges along with tunnels number 14, 15 and 16 on the 63 kilometer long railway line from Punjab to Bilaspur, had complained to the police after this incident and the tunnel was demolished.

DBL Company has taken a tender of about 700 crores on this track, under which tunnel number 14 and other two tunnels and two bridges are being built.

It is being told that the drilling pipe and hole of the borewell, which became an obstacle in the tunnel, has been filled with cement from bottom to top. Instructions have been given to keep the pipe inserted inside it.

Along with this, the hole has also been covered with welding from above, so that no one can tamper with it. Till the completion of the investigation, the pipes and incomplete borewell will remain like this.

Rakesh Anand, Public Relations Officer of DBL Company, said that instructions have come to start the tunnel work of the rail line, about which the administrative officials have also been informed.

He told that now once again the tunnel work will be started at a fast pace.

In these 10 villages, the land of 1763 villagers is coming under the jurisdiction of Fourlane, who will be given a compensation of about 49 crore 27 lakhs.

The assessment of the structure has been done by an independent agency on behalf of NHAI, according to which 34 buildings will be demolished, while the land acquisition authority will get its assessment done by the Public Works Department at its own level.

The compensation will be given separately after the final report of the structure coming in the JD of the road and the trees to be cut. As per the information, special camps are being organized in the concerned areas to get the bank account details from the affected people at the earliest.

In this series, employees of the concerned department will be available in villages Sai Brahmana, Dravsai and Sai Ugiulla in the camp to be organized at Patwarkhana Dhalot on February 17.

On the basis of these two legal documents, the Law Department needs advice as to whether there will be any loss to the state after going to old pension. What are the legal options available with the state?

NPS was implemented in Himachal with effect from 15-05-2003, the decision regarding which was taken by the then Government on 17-08-2006. This means that Virbhadra Singh government had implemented NPS in Himachal and the agreement to come to NPS was signed during the time of the Dhumal government.

The agreement was signed on behalf of the state government by the then Special Secretary Finance Akshay Sood, who is now the Finance Secretary. It was signed by NR Rayudu, CEO of, NPS on behalf of the Government of India. Two other witnesses were also from the Government of India.

What will be the loss of breaking the NPS agreement

There is no exit clause in this agreement. Clause-03 states that the state government has fully understood the NPS structure and the state is in complete agreement with this arrangement of the Government of India.

On this basis, Himachal had made the Himachal Pradesh Civil Services Contributory Pension Rules-2006. There will be a change in these rules for old pension. In this agreement, the state government had given a guarantee that it would fulfill every commitment of NPS.

Clause 10 of the agreement provides that if the state does not agree to any of the provisions, the matter shall be referred to the PFRDA and thereafter an arbitrator shall be appointed.

Now because the Sukhu government has decided to implement old pension, the government does not even have the option of going to arbitration.

The File has not yet Returned from the Law Department

Clause 11 of the NPS Agreement states that any dispute shall be subject to the jurisdiction of Delhi Courts only. Clause 13 provides that the State Government cannot transfer any responsibility relating to NPS under the agreement.

The file has not yet been returned from the Law Department, so the matter of old pension will not be discussed in the cabinet meeting on February 16.

The Finance Department of the Himachal Government had written a letter to the Government of India to return the 14% contribution of the State Government before taking the decision to implement the old pension.

In response to this, PFRDA had said that no such provision is there in the agreement, hence the money cannot be refunded. This money will be given to the employee only on retirement. After this, the Finance Department has sent a letter to the Union Finance Ministry.

The answer has not come yet. According to the decision taken in the first cabinet on January 13, the office memorandum has also been sent separately to PFRDA. There has been no response on this either.
